1. Acceptance of Terms

These terms constitute a binding agreement between ProviaPack (Seller) and any visitor, inquiry submitter or buyer (Buyer). By browsing our website, submitting contact information, requesting quotes, ordering samples or placing orders, you acknowledge that you have read and fully accept all terms below. Any additional buyer terms require our written email confirmation to be valid.

2. Website & Customer Information Collection

Our website collects contact details including name, email address, phone number and business requirements solely to respond to your food packaging inquiries, send quotations, arrange samples and handle order communication.

• We will not sell, rent or share your contact information with unrelated third parties without your written consent.
• You guarantee all information you submit is true and accurate.

3. Quotation Validity

All quotations are valid for 30 days from the issued date. ProviaPack reserves the right to adjust prices due to raw material fluctuations, exchange rate changes or specification updates. Prices are quoted EXW or FOB China unless otherwise agreed. Destination freight, duties and customs fees shall be borne by Buyer.

4. Orders & Artwork Approval

An official order is confirmed only after we issue a Proforma Invoice and receive the required deposit. All customized printed food packaging has applicable MOQ stated in quotations.

Buyer shall provide complete artwork, logos and specifications. We supply digital proofs for your confirmation before mass production. Once artwork / pre-production sample is approved, ProviaPack is not liable for errors arising from your confirmed files. Any later revisions will generate extra costs and extended lead time.

5. Sample Service

• Standard stock samples can be provided; buyer covers courier shipping cost.
• Custom printed samples require full pre-payment before production.
• Sample lead time: 3–7 working days after artwork approval and payment.

6. Payment Terms

• Samples: 100% payment in advance.
• Bulk orders: 30% deposit upon PI confirmation; 70% balance payable before shipment.
• Accepted payment: T/T wire transfer. Buyer covers all bank charges on their side.

7. Production & Delivery

Lead times are estimated and start after deposit receipt and artwork approval. Delays caused by buyer’s late confirmation, payment delay or specification changes are not our responsibility. Risk of goods transfers to Buyer once goods leave our factory or are loaded on vessel. Goods inspection claim with photos/videos must be submitted within 7 days after receipt of shipment.

8. Quality & Liability

Our food-grade packaging complies with China relevant standards. It is Buyer’s obligation to verify compliance with local import and food safety regulations. Normal industry tolerance including minor color difference and size deviation ±3% will not be regarded as defects.

Our maximum liability for any defective goods shall not exceed the invoice value of the relevant batch. We are not responsible for indirect losses such as lost profits.

9. Cancellation Policy

Custom printed packaging cannot be returned or exchanged after production starts. If buyer cancels after deposit payment before production begins, deposit will be retained. If production has started, buyer shall pay full order amount.

10. Force Majeure

ProviaPack shall not be liable for delays or failure of delivery caused by events beyond reasonable control, including natural disasters, raw material shortage, port congestion, logistics suspension and policy changes. We will notify buyers promptly and reschedule delivery where possible.

11. Governing Law & Disputes

This agreement is governed by the laws of People’s Republic of China. Any disputes shall first be resolved by friendly negotiation. If negotiation fails, disputes shall be submitted to arbitration in Guangdong, China.

12. Revision of Terms

We reserve the right to update these Terms & Conditions by publishing revisions on https://proviapack.com. Continued use of the website or cooperation constitutes acceptance of updated terms.
